This website is owned and operated by Artfolios LLC—a Winston-Salem, North Carolina based online Art Gallery. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors fine art originals. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

 

Age of Patrons: In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

 

Your Responsibilities: When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

Prices and Corrections: The prices we charge for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur.

Color Accuracy: Much care is given by Artfolios' artists to supply images that accurately reflect their artwork, but please note Artfolios does not guarantee color accuracy as each monitor and device showcases color differently. 

 

Tax: All prices are listed pre-tax. North Carolina sales tax will be added during the check-out process.

 

Purchased Artwork: All artwork purchased through Artfolios’ site will be picked up by our Patrons at Artfolios Headquarters; 504 Miller Street; Winston-Salem, NC 27103. We strive to have artwork ready for pick up within two (2) weeks of purchase. You will be contacted at the email and/or phone number supplied during check out to schedule an appointment for pick up. We do not ship artwork. **Artwork pick up and shipping exceptions are noted within product listings.**

 

Special Delivery Needs, Large Orders, and Patron beyond the Triad of North Carolina: If you have special delivery needs, are planning to place a large order, or are a Patron beyond the Triad of North Carolina, please reach out to us at inquiry@Artfolios.shop before you make a purchase so that we can discuss your needs and assist with finding the right delivery solution.

 

Refunds: All sales are final.

 

Privacy Policy: We respect and are committed to protecting your privacy. We may collect personally identifiable information when you visit our site. We also automatically receive and record information on our server logs from your browser including IP address, cookie information and the page(s) you visited. We will not sell your personally identifiable information to anyone. 

 

Security Policy: Your payment and personal information is always safe. Our Secure Sockets Layer (SSL) software is the industry standard and among the best software available today for secure commerce transactions. It encrypts all of your personal information, including credit card number, name, and address, so that it cannot be read over the internet. 

 

Right to Change and Modify Terms: We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review this page periodically. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

 

Promotional Emails and Content: You agree to receive promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices—please notify us at any time. 

 

Indemnification: To the fullest extent permitted by law, our Patrons shall indemnify and hold harmless Artfolios LLC from and against claims, damages, losses, and expenses (including without limitation reasonable attorney’s fees and dispute resolution costs) (collectively “Loss”) to the extent that fault of the Patron or its derivative parties is a proximate cause of the Loss. In matters involving bodily injury or property damage, indemnification by the Patron shall not be required if the bodily injury or property damages arises from the negligence, in whole or in part, of Artfolios LLC. The terms “fault” and “derivative parties” as used in this section shall have the meanings given in N.C. Gen. Stat. § 22B-1.

 

Severability: If any provision of these Terms and Conditions shall be determined to be contrary to law and unenforceable by a court of competent jurisdiction, the remaining provisions shall be severable and enforceable in accordance with their terms.
